Terms of Service

By commissioning me, you agree to the following terms, if you have any issues with the terms, they must be discussed before the commission and require documentation for proof of amendment agreement.

GENERAL TERMS

  • Prices are subject to change based on demand.

  • Shipping is NOT included in the quote or initial invoice of custom items. Shipping rates are determined and charged after product is completed. Local or convention pick-up is an alternative delivery option.

  • You must be 18 years or older to commission.

  • By submitting a character design for a custom suit, it must be your own original design. I do not claim responsibility for fulfilling a commission where the customer used a character that is someone else’s intellectual property without my knowledge.

  • I have the right to reject any commission request for any reason.​​

  • I have the right to terminate commissions and issue refund without having to justify myself in doing so.

  • Allergy Warning: My dog is not hypoallergenic and occupies my workspace and I occasionally burn incense. If you have serious dog allergies, I would recommend caution or not to commission for your health.

PAYMENT

  • Currency accepted through Square Invoice or Stripe Invoice for online transactions. Paypal is not accepted as alternative payment method for commissions. Payment installments will be separate invoices send to customer and additional fees may apply.

  • Commissions can be paid in full or 30% deposit and paid off within the following 3-6 months. Payment plans are allowed but subject to up to a 10% price increase. Shipping is NOT included in invoice, shipping is to be determined after product completion.

  • Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.

  • If payment is made in the case of termination of commission due to unacceptable behavior of customer, you will be charged up to $200 in fees in addition to any work already made prior to cancellation and refunded the remainder.

PROCESS AND DELIVERY

Fursuit Making:

  • The customer can state a deadline that would be ideal, however I am not obligated to meet this time span unless it is reasonable. It is possible to expedite usual deadlines for an additional 50% of the cost of the suit should it be in reason.

    • Fursuit Head estimated deadline: 3-4 months from final payment

    • Fursuit Partial estimated deadline: 5-7 months from final payment

    • Fursuit Fullsuit estimated deadline: 8-12 months from final payment

    • Fursuit Parts and props (when head is not included) estimated deadline: 3-8 months from final payment

  • If you commission me, you agree to not ask for a style change. If you are ordering from me, you should be doing so for my fursuit style. You are welcome to go elsewhere if my style is not for you. When ordering a Toony suit, under no circumstances will I work with follow-me eyes. I only offer 2D eyes, I do not work with follow-me eye style. Feetpaws are exclusively shoe-in style. My fursuit heads are made on custom 3-D printed bases (sculpted and printed in my personal studio) with adjustable velcro straps and zipper closures.

  • I will notify you upon the start of the commission and keep you up to date on progress, any questions that I have and any hold ups in the progress.

  • Once the fursuit is completed, I will calculate the cost for shipping. You may request without insurance but otherwise insurance will be included. Once shipping cost is determined, the suit will not be shipped until payment for shipping is received.

  • Mailing address must match address on invoice. If correction needs to be changed after payment made, please send correct address on shipping invoice.

REVISIONS

  • You will be given updates on the progress of the commission, upon each edit, you are entitled two minor edits, any other edits will come with an extra charge outside of the flat rate of the commission. What is considered a minor edit is circumstantial.

  • A fee will be added if you want something changed on the final fursuit.
     If you wish for me to change something in the fursuit you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

  • If your reference is unclear to start with changes will come at an extra charge. 

COPYRIGHT / USAGE POLICY

The Pyrate Cove claims the rights to the produced artwork, not the buyer. I own the copyrighted artwork to:

  • Promote myself with it everywhere

  • Publish books with it (artbooks, etc.) Display it everywhere to my liking (website, social media, etc.)

  • Post it wherever I want


 The buyer is allowed to:

  • Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)

  • Print the artwork and claim the character(s) as their own, but not the artwork itself.

  • Use the artwork to promote themselves. You are not required to give me credit when you post it but it is very appreciated.

  • Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.
     

The following is considered copyright infringement:

  • Reproduce or create derivative works of the copyrighted work for yourself or another person.

  • Claiming the artwork as your own

  • Removing my signature from the artwork

  • Altering the artwork without my consent
     

I own the full rights to the pictures, drawings and all artistic documentation of the fursuit and it's use/distribution unless otherwise agreed upon. ​

For Fursuit work:

  • I MUST be credited as the maker. You cannot claim to be the maker— you are the owner and can reserve rights to owning the character and suit, just not the craft into making it.

  • If you are to resell, you must contact me first if you plan to sell for more than the amount you paid for.

WARRANTY / AFTER CARE

Warranty and aftercare does not apply to illustrated badges or illustrations.

For Fursuit work:

  • You have a 90 day warranty to get fixes for any defects or popped seams complimentary. Shipping is the responsibility of the customer.

  • Any repairs after the 90 days but within 1 year of delivery can be sent back to me for a fee. Shipping is the responsibility of the customer.

  • Repairs needed after 1 year are on a case by case basis and if the repairs needed are inhibiting wear, we can talk about potential for commissioning a replacement part for a return customer discount.

  • Major repairs, revisions, or refurbs made by anyone other than The Pyrate Cove voids the warranty. (This includes the adding of SPH’s, I do offer adding these options in commissions and so adding them afterwards disqualifies you from the warranty)

  • If the suit is past warranty or the warranty has been voided but you would still like to return for repair of refurb, I will repair for a minumum fee of $250 and, after receiving the suit, can further assess the issue and give an estimate for repair. If the suit repair exceeds $1000, we can talk about potential for replacement of parts with a discount on said part.

  • To prevent a need for repair, please follow the aftercare instructions:

    • Sanitize fursuit heads and parts after every wear. Fursuits both premade and custom are mailed with fursuit spray and can be also homemade or purchased.

    • Fursuit parts (excluding the head and any foam parts such as foam based tails and some feetpaws) can be machine washed but with care. Delicate and COLD settings in a pillow case or laundry bag. Be wary about your dryer. If there is a NO HEAT option, I suggest testing it on scrap faux fur first, otherwise air dry with fan and/or in a high ventilated area. Take out tail stuffing BEFORE washing and do NOT put polyfil back into tail until full dried! Small tails may not have a removable stuffing, if this is the case, disregard. Brush out after cleaning, periodically while drying, and before storing and periodically brush in storage.

    • Avoid storage that will cause wrinkles. If there are any wrinkles occur, refer to this video for fixing wrinkles: Fix Damaged or Wrinkled Faux Fur

    • Fursuit heads should NEVER be machine washed and the submersion technique hasn’t been tested on my heads yet and is discouraged. Little Green machine works on fursuits without airbrushing. Any airbrush damage that is faded or ran due to improper cleaning voids complimentary airbrush touch up. Spot cleaning is suggested for fursuits with airbrush marks and avoid spraying fursuit spray directly on airbrushed parts as it will cause fading.

    • Store fursuit heads on mounts and in a cool place to avoid damage.

Please contact me BEFORE any serious consideration to repairs and revisions if you want to retain your warranty. Any alterations to my suits without consulting me is immediately considered a void of your warranty. (NOTE: even if you message me when it happens and alter it before I respond due to an emergency repair, this counts as consulting me beforehand and shouldn’t void warranty. Circumstances may change warranty. This is why you should reach out either way.)

CUSTOMER SATISFACTION

  •  If you have a problem with anything in regards to the commissioned piece please tell me.

REFUND / CANCELLATION POLICY

  • If for any reason, I am not able to start the commission after 1 year, customers will receive a full refund.

  • If a cancellation has to be made by your request, you will be charged a cancellation fee. The cancellation fee will be 10% of the payment rendered at the time of cancellation. If any drafts or purchases or work has been made, you will be refunded for payments with the exception of work and labor and the 10% cancellation fee. You may request for the fabric materials but work such as the base, etc has been made, I will not provide the work in progress, I will repurpose your suit and refund according to work already made.

  • If parts of the commission have been finished but the original order is not complete, you will be sent the items completed and shipping for the items will be subtracted from the refund given. For example, if you ordered a fullsuit and cancel the commission after the head and paws are complete, you will receive the head and paws. You are not entitled to decline what has been completed and by cancelling, you forfeit the option to upgrade the suit at a later time.

  • If the fursuit is 50% or more completed, you with not receive a request a refund. You will get the completed suit as soon as possible. If you refuse to provide shipping costs for the suit and if the chargeback is initiated before mailing out the suit, we will dispute the chargeback and hold the suit for 30 days. If resolution isn’t made after the 30 days, suit will be alter design and resell suit.

  • If you are cancelling a commission at any point, you will be blacklisted from future commissions.

  • If you are getting a refund, do not request a chargeback. I will transfer the money back to you myself.

  • If you request a chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will send supporting documentation to Square as proof of the legitimacy of our transaction (receipt, conversations, etc). Furthermore, you will be blacklisted for commissioning me again.​

  • If the buyer breaks any of the points stated above they will lose all the before mentioned rights to the artwork made by The Pyrate Cove, and I will have the right to profit further from the commissioned artwork in any way I see fit.

What do you get?

For Fursuits:

  • Drafts of how I will approach the character being created.

  • Progress shots every significant step of the construction of the fursuit.

  • Updates on anything holding up the progress of the commission.

  • The finished fursuit mailed to you with tracking and insurance.
